There is a class action lawsuit involving those who purchased Flonase nasal spray directly from SmithKline Beecham Corporation d/b/a GlaxoSmithKline, plc (“Defendant”) in the United States. The case, In re Flonase Antitrust Litigation, No. 08-CV-3149, is pending in the United States District Court for the Eastern District of Pennsylvania. The Lawsuit claims that GSK violated federal antitrust laws by wrongfully delaying the introduction of generic versions of the prescription drug Flonase into the United States market. It further claims these actions injured Class Members by causing them to pay higher prices for Flonase and generic versions of Flonase. GSK denies any wrongdoing.

|On June 14, 2013 the Court granted Final Approval of the Settlement.
The Class is defined as:
All persons or entities in the United States and its territories who purchased Flonase nasal spray directly from Defendant (or any of its predecessors or affiliates) at any time from May 19, 2004 until March 6, 2006 (“Class Period”), excluding Defendant, its predecessors, officers, directors, management, employees, subsidiaries, parent or affiliates, and governmental entities or persons.
This Class was certified to proceed as a class action by the Court’s November 10, 2010 Order, as modified by the Court’s February 9, 2011 Order. Notice was disseminated to all Class Members by first class mail on or about May 9, 2011. No Class Member opted out by the July 8, 2011 deadline and therefore, all Class Members will be bound by, and may participate in, the Settlement.
What does the Settlement Provide?
GSK has agreed to pay $150 million in cash into a Settlement Fund, which will include any interest that accrues. Attorneys’ expenses and fees, Settlement administration costs, and incentive awards to the Named Plaintiffs will be paid from the Settlement Fund. The remainder of the Settlement Fund (“Net Settlement Fund”) will be divided among Class Members on a pro rata basis based upon their direct purchases of Flonase.
